United States employers must now use the latest version of Form I-9 (edition date 08/01/23), intended for new hires and not current employees, released by USCIS. A revised Spanish-language version is also now available for employers in Puerto Rico. The updated form and instructions are on the USCIS website, along with an updated Handbook for Employers.
Remote examination of employees’ Form I-9 documents may also continue for employers who are in good standing with E-Verify as long as they do so consistently at E-Verify hiring sites. However, they must maintain physical in-person examination for onsite or hybrid employees.
